On the death of the 1st Duke of Warwick both the Dukedom and Earldom of Warwick became extinct (see Editor's Note below) and the Barony of Burghersh passed to his only child, Lady Anne de Beauchamp. On her death in 1449 the Barony fell into abeyance between her aunts (the daughters of Isabel, her grandmother, by her two husbands) or their descendants.

Editor's note:

There is some uncertainty as to whether the Earldom of Warwick became extinct on the death of the 1st Duke of Warwick and reverted to the Crown, or whether it passed to his infant daughter Lady Anne de Beauchamp, and then a few years later to his sister of the whole blood, also called Lady Anne de Beauchamp. Circumstantial evidence seems to point to the Earldom being regarded from the mid 14th century onwards as only being capable of passing to heirs male rather than heirs general.

For example, in 1344 the 11th Earl of Warwick entailed Warwick Castle and most of his lands in many counties to his sons Guy, Thomas and Reynbrun, in tail male, with remainder to any other son and to his brother, John [de Beauchamp], 1st Baron Beauchamp of Warwick, also in tail male, and with ultimate remainder to his right heirs, the heirs general being ignored. Gower, which he had claimed and secured as heir general, was similarly entailed in 1356, with the inclusion of his younger sons William and Roger. It seems clear that the intention was to limit the Earldom itself, as well as the lands, to the heirs male of the body of the 10th Earl of Warwick, thus bringing it into line with other 14th century creations. It has been said, "It is obviously absurd to suppose that the King intended the estates ..... of an Earldom to descend in a different way from the Earldom."

When the 11th Earl of Warwick died in 1369 he was succeeded by his eldest surviving son, Sir Thomas de Beauchamp, the heir male of the first grantee, rather than his grand-daughter Katherine de Beauchamp, the heir general of the first grantee as the only surviving child of his first son and heir apparent, Sir Guy de Beauchamp. The entail of 1344 prevented her from inheriting any of her grandfather's lands or, it would appear, the Earldom itself.

The 14th Earl of Warwick was created Premier Earl in 1444 and Duke of Warwick in 1445, both of these new creations being to the heirs male of his body. His only child, Lady Anne de Beauchamp, was born before both of these creations and presumably there was no reason to suppose that the 14th Earl later 1st Duke of Warwick would not on the future produce a male heir. Even so, it is unlikely that the King would agree to terminology in letters patent that could, however remotely, result in the Earldom of Warwick descending one way and the Dukedom of Warwick descending another.

Finally, there is the creation of Lady Anne de Beauchamp, the late Duke's sister, and her husband Sir Richard Nevill, the son and heir apparent of the Lady Alice, suo jure Countess of Salisbury, as Earl and Countess of Warwick for life on 2 Mar 1449/50. If Lady Anne had already inherited the Earldom of Warwick from her niece, would there have been any need for this creation? Could not her husband have been acknowledged as Earl of Warwick jure uxoris, just as his own father was acknowledged as Earl of Salisbury jure uxoris. The fact of this new creation and its extended remainder does strongly suggest that the 1088 Earldom was regarded as having become extinct on the death of the Duke of Warwick in 1446.

Although the evidence is, as we stated earlier, entirely circumstantial, regarding the 1088 Earldom of Warwick as having become extinct in 1446 does seem the correct approach to take. It should be pointed out that The Complete Peerage makes no firm decision either way and allows the 1098 Earldom of Warwick with a caution to both the Lady Annes.
