On the death of the 8th Earl of Traquair it is assumed that the Earldom of Traquair became extinct. As far as it is known the male issue of the 1st Earl of Traquair (and probably also that of his great-grandfather, the legitimated son of the 1st Earl of Buchan) became extinct with the death of the 8th Earl of Traquair in 1861. The question remains whether the legitimation of 1489 is sufficient to enable the collateral male heirs of the first James Stewart of Traquair to succeed to the Earldom.
