6 May 1663 Baroness Lucas of Crudwell, of Crudwell in the County of Wiltshire, with remainder to her heirs male by the said Earl of Kent with the proviso "that if at any time or times after the death of the said Mary, Countess of Kent, and in default of issue male of her body by the said Earl begotten, there shall be more persons than one who shall be coheirs of her body by the said Earl, so that the King of his heirs might declare which of them should have the dignity, or otherwise the dignity should be suspended or extinguished, then, nevertheless, the dignity should not be suspended or extinguished, but should go and be held and enjoyed from time to time by such of the said coheirs as by source of descent and the common law of the realm should be inheritable in other entire and indivisible inheritancy, as namely, an office of honour and public trust, or a castle for the necessary defence of the realm,and the like, in case such inheritance had been given and limited to the said Countess and the heirs of her body by the said Earl begotten."

on 15 Aug 1871 he was declared to have inherited, as heir general of Thomas [Butler], 1st Baron Butler of Moore Park, styled Earl of Ossory, eldest son of James [Butler], 1st Duke of Ormonde, the Barony of Butler of Moore Park, of Moore Park in the County of Hampshire (writ sum. 14 Sep 1666), in the Peerage of England and the Lordship of Dingwall (cr. 8 Jun 1609) in the Peerage of Scotland, the attainder affecting those titles having been reversed in that year. On his death the Earldom of Cowper (together with the Viscountcy of Fordwich and the Barony of Cowper) became extinct, the Barony of Butler of Moore Park fell into abeyance among his sisters and their heirs, and the Barony of Lucas of Crudwell and the Lordship of Dingwall devolved on his nephew and heir general,
