his name appears in the Parliament Roll of 1685 as "under age"; the anomalous precedency of this Barony in Parliament of being the premier barony was challenged 1669/70 by Lord Fitzwalter, who sat under a writ of 1295; Chief Larderer at the Coronation of King James II 1685; on the death of the 2nd Baron Bergavenny the Barony was claimed by his cousin and heir male, George Nevill, but as a Barony in fee it should have passed to his niece, Frances Shelley, later Lady FitzWilliam

On the death of the 9th Viscount FitzWilliam the Viscountcy of FitzWilliam became extinct and the Barony of Bergavenny fell into abeyance between the descendants of the 9th Viscount's two aunts, Mary, Countess of Pembroke, and Frances, Lady Carbery.
