Warden of the West Marches 1571-77; created Earl of Morton on the attainder of his maternal uncle James [Douglas], 4th Earl of Morton, which title was taken from him when the attainder of the Earl of Morton was reversed 1585/6; a devout Catholic, he was given leave to depart Scotland during the King's pleasure and fled to Madrid 1587, where he joined in the planning of the Spanish Armada; returning to Scotland without permission in 1588 he was declared a traitor and arrested ; released on a bond of £100,000 in 1589, he was restored to the Stewardry of Annandale 1590 and the Wardenship of the West Marches 1592; he was killed in a fight with the Johnstone's at Dryffe Sands

unhappy with his father being deprived of the Earldom of Morton he caused great trouble on the West March; in 1607 the Privy Council decided it would be unsafe for both Lord Maxwell and the Earl of Morton to attend Parliament together, and so Lord Maxwell was ordered to return home; nevertheless Lord Maxwell attended and challenged the Earl's right to the title, for which he was arrested and imprisoned in Edinburgh Castle, from where he escaped; in Apr 1608 he avenged his father's death by killing Sir James Johnstone; he fled to England and was declared guilty of treason by the Scottish Parliament in 1609; returning to Scotland in 1612 he was arrested and the next year beheaded at Edinburgh

The Lordship of Maxwell was held by the Earls of Nithsdale from 29 Aug 1620 until 19 Jan 1715/6, when William [Maxwell], 5th Earl of Nithsdale, 13th Lord Maxwell, etc., was attainted for high treason and his titles forfeited to the Crown.
