surrendered his honours to the Crown and obtained a novodamus 1 Oct 1726 made subject to certain conditions, principally settling the Annandale lands and titles on his sister Lady Henrietta Johnstone and thereby disinheriting his two half-brothers; on his death the entail was successfully challenged by his step-mother acting on behalf of her infant son with judgement being given in her favour in 1733

On the death of the 3rd Marquess of Annandale the Marquessate of Annandale and other titles created in 1701 became extinct as did the Earldom of Hartfell and Annandale, etc. created on 13 Feb 1661 with precedency from 18 Mar 1642/3; the Earldom of Annandale and Hartfell, etc. created on 23 Apr 1662, again with precedency from 18 Mar 1642/3, became dormant and this latter earldom was unsuccessfully claimed by his grand-nephew, James [Hope later Hope-Johnstone], 3rd Earl of Hopetoun (who had inherited the Annandale estates); in 1995 his descendant Patrick Andrew Wentworth Hope Johnstone of Annandale and of that Ilk was recognised as 11th Earl of Annandale and Hartfell.
