On the death of the 7th Earl of Wigtown in 1747 the Earldom of Wigtown became extinct. Shortly after the death of the 7th Earl of Wigtown the title was assumed by Dr Charles Ross Flemyng, of Dublin, who claimed to be a descendant of Hon Alexander Fleming, 4th son of the 1st Earl of Wigtown. He was debarred by the House of Lords' Committee for Privileges from assuming the title until he had established his claim to it. This he never did.
