after the attainder of his eldest son he made a new entail of his estates on 31 Jul 1750 in favour of his 3rd son, Hon James Wemyss MP; on the 5th Earl of Wemyss's death in 1756 his titles became forfeited due to his eldest son's attainder in 1746, but Lord Elcho styled himself 6th Earl of Wemyss until his death in 1787; in 1729 his second son, Hon Francis Wemyss later Charteris had assumed (at the age of six!) the surname of Charteris in lieu of that of Wemyss on being adopted as heir by his maternal grandfather and in 1771 he was permitted by an Act of Parliament to retain the surname and arms of Charteris and the entailed estates of his maternal grandfather in the event of his succeeding to the Earldom of Wemyss or any other dignity despite the provision to the contrary in the letters patent creating the Earldom of Wemyss; following the death of his elder brother in 1787 he was known incorrectly as the 7th Earl of Wemyss under the widely held belief that he was unaffected by the attainder because he did not have a descent from his brother and thereby a corruption in blood

following the death of his father on 20 Jan 1808 he styled himself Lord Elcho until 24 Aug 1808 when, following the death of his paternal grandfather, he styled himself Earl of Wemyss; on the death of his kinsman the 4th Duke of Queensberry on 23 Dec 1810 he also claimed the Earldom of March and the lands and Lordship of Neidpath as heir male of his great-great-grandmother, Lady Anne Douglas, first wife of David [Wemyss], 4th Earl of Wemyss, only dau. of William [Douglas], 1st Duke of Queensberry, and sister of Hon William Douglas, who had been created Earl of March on 20 Apr 1697 with remainder to the heirs of entail of the lands of Neidpath - this claim has never been proven in a court of law although the Roll of Scottish peers allowed to vote for representatives in the House of Lords included the Earldoms of both Wemyss and March;   on 26 May 1826 he was restored to the Earldom of Wemyss by the reversal of the attainder of 1746 by an Act of Parliament
