On 30 Jul 1703 the 2nd Viscount of Oxfuird entailed his lands and barony of Cranston-Macgill on Col Hon George Makgill, his brother, and the heirs-male of his body, whom failing on Hon Christian Makgill, his own eldest daughter and spouse of Hon William Maitland, brother-german of the Earl of Lauderdale, whom failing on Hon Henrietta Makgill, his second daughter and spouse of James Hamilton, Yr. of Orbistoun, whom failing on James Hamilton of Falahill, whom failing on Col Thomas Hamilton, his brother-german, whom failing on Col John Hamilton, their brother-german, and on the heirs-male of the body of each heir in succession, whom failing on the grantee's own nearest heirs and assignees.

 

Following the death of the 2nd Viscount the Viscountcy of Oxfuird was assumed in succession under the 1703 bond of tailzie by his eldest daughter, his grandson and his youngest daughter. Following the death of Hon Henrietta Hamilton, self styled Viscountess of Oxfuird, in 1758 it was assumed that the Viscountcy was either dormant or extinct.

 

In 1977 the Committee for Privileges agreed that Sir Donald Makgill, 12th Bt., had made out his case that the bond of tailzie executed by the 2nd Viscount in 1703 and the subsequent Charter of 1706, under which his daughter Christian claimed both the estates and the title, was not valid in law, and that the provision of the original letters patent of 1651 for a remainder to heirs male was still operative;  since all collateral heirs male had failed, Sir Donald Makgill, as the sole remaining heir male, was entitled to the Viscountcy and Lordship:
