The Barony of Hastings was held by the Earls of Pembroke from 13 Oct 1339 until 30 Dec 1389, when on the death of John [Hastings], 14th or 3rd Earl of Pembroke and 5th Baron Hastings, the Earldom of Pembroke became extinct and the Barony of Hastings became dormant, but of right (according to the decision in 1840) vested in his cousin of the half-blood:

knighted before 1399; the celebrated contest in the Court of Chivalry as to his right of bearing the arms of Hastings without any difference was decided against him on 9 May 1410 in favour of Reynold [de Grey], 3rd Baron Grey of Ruthin, heir to the sister of the whole blood, in preference to his own claim as brother of the half blood, of John [Hastings], 2nd Baron Hastings, ancestor of the Earls of Pembroke.  From this decision he appealed but finally, on refusing to pay the costs of this case he was imprisoned in the Marshalsea Prison where he remained until his death 20 years later.

On his death the right to the Barony of Hastings fell into abeyance between his two sisters:  (i) Anne, wife of William Browne, of Elsing, co. Norfolk; and (ii) Elizabeth, wife of Hamon L'Estrange, of Hunstanton, co. Norfolk.  The abeyance was terminated on 18 May 1841 after 299 years in favour of the junior co-heir, despite the fact that he represented only one quarter of the barony and there were other two more senior claimants: Henry L'Estrange Styleman, who represented another but more senior quarter of the barony, and Frances Berney, wife of Rev Richard Eaton later Browne, who represented the senior moiety or half of the barony.
