On the death of the 9th Lord Borthwick the Lordship of Borthwick became dormant until 8 Apr 1762, when the claim by Henry Borthwick of Mayshiell to be the 14th Lord Borthwick was recognised by the House of Lords. On the death of the 14th Lord Borthwick the Lordship of Borthwick once again became dormant until 1870, when the claim by Cunninghame Borthwick was allowed by the House of Lords. After the death of the 14th Lord Borthwick the right to the Lordship of Borthwick passed to his fourth cousin once removed, Patrick Borthwick:

On the death of the 20th Lord Borthwick the title once again became dormant until 1986, when the claim to the Lordship of Borthwick by John Henry Stewart Borthwick, 17th of Crookston, was admitted by the Lord Lyon King of Arms.
