With the death of the 5th Lord Belhaven and Stenton the heirs male of the body of the 2nd Lord Belhaven and Stenton became extinct.

 

The peerage was assumed by Capt William Hamilton of Udston, lineal descendant and heir male of John Hamilton of Coltness, the elder brother of the above named James Hamilton of Barncleuch, the grandfather of the 2nd Lord Belhaven and Stenton. He voted as Lord Belhaven and Stenton in the election of Scottish Peers in 1790.  However, this assumption was contrary to Scots law whereby in the case of three or more brothers the next youngest brother and not the eldest brother is heir at law.  It was resolved by the Committee for Privileges on 5 Jun 1793 that his vote was "not good", which resolution was confirmed by the House of Lords.  He died 19 Jan 1796.

 

Robert Hamilton, 6th of Wishaw, was entitled to the peerage as "heir male whatsoever" of the 2nd Lord Belhaven and Stenton, being the lineal descendant and heir male of William Hamilton of Wishaw, the younger brother of the above named James Hamilton of Barncleuch. He never assumed the title:
