The Earldom of Annandale and Hartfell was held by the Marquesses of Annandale from 24 Jun 1701 until 29 Apr 1792, when George [Johnstone later Vanden Bempde], 3rd Marquess of Annandale, 4th Earl of Annandale and Hartfell, etc. died unmarried;  on his death the Marquessate of Annandale and other titles created in 1701 became extinct as probably did the Earldom of Hartfell, created in 1643 and regranted as the Earldom of Annandale and Hartfell in 1661,  The decision of the House of Lords in 1985 is that the effect of the 1662 charter was to create a second Earldom of Annandale and Hartfell and the right to this second earldom passed in 1792 to

the claim to the title was recognised in 1985 by the Committee for Privileges on the grounds that the charter of 23 April 1662 acted as a new grant of the Earldom of Annandale and Hartfell and Lordship of Johnstone to a new series of heirs, redirecting the titles to the heirs male of the body of James [Johnstone], 1st Earl of Annandale and Hartfell (as opposed to the grant of 1661 which was to heirs male).  As stated above, failing heirs male of the body the remainder was to heirs female of his body and their heirs male of their body.  With the death of George [Johnstone], 3rd Marquess of Annandale, 2nd Earl of Annandale and Hartfell, etc. the heirs male of the body of James [Johnstone], 1st Earl of Annandale and Hartfell, became extinct.  As can be seen above, the claimant descended from Lady Anne Hope-Johnstone, eldest heir female of the body of James [Johnstone], 1st Earl of Annandale and Hartfell, and daughter of James [Hope], 3rd Earl of Hopetoun and grandson of the elder daughter of William [Johnstone], 1st Marquess of Annandale.  The Committee for Privileges decision meant that there were two Earldoms of Annandale and Hartfell existing at the same time between 1662 and 1792 but with different destinations.
